The Labour Court at Hazaribag has been constituted by the
appropriate Government by exercising the power under section 7
of the Industrial Dispute Act, 1947 on 24.06.1986 for the
adjudication of industrial disputes relating to any matter
specified in the Second Schedule and fro performing such other
function as may be assigned to them under the Act |
Section 7(3) of the Industrial Disputes Act 1947 reads “A person
shall not be qualified for appointment as presiding officer of a
Labour Court, unless – |

(a)
He
is, or has been, a Judge of High Court; or |
|
(b) He has,
for a period of not less than three years, been a District Judge
or an Additional District Judge, or |
|
(c) (****) |

(d) He has
held any Judicial office in India for not less than seen years;
or |
|
e) He has
been the Presiding Officer of a Labour Court constituted under
any provincial Act or State Act for not less than five years. |

Since 12.12.2001 only District Judges have been occupying the
post of Presiding Officer of Labour Court, Hazaribag. |
|
At present the territorial jurisdiction of the Labour Court,
Hazaribag covers the revenue districts of Hazaribag, Giridih,
Koderma, Chatra and Ramgarh. |
|
A-part from adjudicating the disputers referred to it under
section 10 of Industrial Dispute Act, 1947 the Labour Court at
Hazaribag interalia has the original Jurisdiction to entertain
applications under section 33C(2) of the Industrial Dispute Act,
1947 under section 26(2) and 28 of Bihar Shops and
Establishments Act and the corresponding provisions of Jharkhand
Shops and Establishments Act.

The Labour
Court, Hazaribag has been designated as the Employee’s Insurance
Court, under section 74(1) of the Employee’s State Insurance
Act, 1948. |

Further the Presiding Officer, Labour Court, Hazaribag has been
appointed as the Authority u/s 20(1) of the Minimum Wages Act
1948 and in that capacity it exercises power u/s 20(2) of the
Minimum Wages Act. The Presiding Officer, Labour Court,
Hazaribag has also been appointed as the authority u/s 15(1) of
the Payment of Wages Act and in that capacity it entertains
applications interalia u/s 15(2) of Payment of wages Act 1936. |

Further the
Presiding Officer, Labour Court, Hazaribag has been appointed as
the Commissioner for the workmen’ Compensation Act u/s 20(1) of
the Workmen’ Compensation Act and in that capacity the Labour
Court, Hazaribag decides the matters referred to it.
